Welcome to Fuddee. These Terms and Conditions (“Terms”) govern your access to and use of the Fuddee website, web application, mobile applications, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Definitions

“User”: Any person accessing the Platform (customers, restaurant partners, delivery partners).
“Restaurant Partner”: Food establishments listed on the Platform.
“Delivery Partner”: Independent individuals or entities responsible for order fulfillment.
“Order”: A request placed by a User for food or services via the Platform.
“Fuddee/We/Us”: M/s Spotsies Soul Foods LLP.

3. Scope of Services

Fuddee acts as a technology aggregator that facilitates the ordering process between Users, Restaurant Partners, and Delivery Partners.

Important: Fuddee does not prepare food. The responsibility for food quality, hygiene, and safety rests solely with the Restaurant Partner.

4. User Eligibility & Account Security

Eligibility: You must be at least 18 years of age and capable of entering into a binding contract.
Account Responsibility: You are responsible for all activities under your credentials. You must notify us immediately of any security breach.
Accuracy: You agree to provide true, current, and complete information during registration.

5. Orders, Payments & Cancellations

Pricing: Prices are set by Restaurant Partners and may change without notice.
Payments: Must be made via approved digital methods. Fuddee may use third-party payment processors.
Cancellations: Orders are subject to our Cancellation & Refund Policy. Once a restaurant begins preparing an order, cancellation may not be possible or may incur a fee.
Right to Refuse: We reserve the right to cancel orders due to technical errors, suspected fraud, or unavailability of items.

6. Delivery Disclaimer

Estimates: Delivery times are estimates only. Factors like traffic, weather, and restaurant preparation time may cause delays.
Third-Party Action: Delivery Partners operate independently. Fuddee is not liable for their conduct but will assist in dispute resolution where possible.

7. User Conduct

Users strictly agree not to:

Provide false or misleading information.
Harass, abuse, or threaten delivery partners or staff.
Use the platform for any fraudulent or illegal activity.
Attempt to circumvent the Platform's security features.

8. Intellectual Property

All content on the Platform—including logos, software, text, and designs—is the property of Fuddee or its licensors. Unauthorized reproduction, modification, or distribution is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by law:

The Platform is provided "as is" and "as available."
Fuddee is not liable for indirect, incidental, or consequential damages.
Our total liability for any claim shall not exceed the value of the specific order giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
